Title Deed
Title deeds are issued under Article 106 of the OSB Implementation Regulation.
In OSBs that used Ministry loans, participants who have paid the allocation price in full, or provided a letter of guarantee for the remaining debt, and submitted a notarised undertaking to contribute without objection to the land prices and other investments set by the OSB, receive mortgage-free title deeds: without a buy-back annotation if they have completed their investment and started production, and with a buy-back annotation if they have not.
At Bafra OSB, the mortgage is released and the title deed transferred three months after production starts.
When a title deed is issued with the buy-back annotation removed, the record states that "transfer of the property to third parties, including by forced sale, requires the OSB's approval". In that case the new owner is deemed to have accepted the previous participant's undertakings.
